Home Office Loses Half of All Immigration Appeals

The newly released statistics for the third quarter of 2017/18 demonstrate that the percentage of immigration decisions being reversed by judges is at its highest level on record. Exactly 50% of appeals to the Immigration Tribunal challenging the Home Office refusals to issue visas to people to stay in the UK now succeed.

Among the appeals that are the most likely to be allowed are Human Rights appeals with a 57% success rate. Among other matters, 50% of all Home Office refusals in the EEA free movement category are successfully being challenged.

These figures confirm the worrying tendency with which the Home Office decides to make unlawful decisions on immigration applications pursuing their own policy rather than the letter of law. The statistics highlight the central role played by judges and the legal system in ensuring that immigration decisions are correctly made.

The figures published by the Ministry of Justice also show an increase in the number of appeals lodged in the first place. There were almost 15,000 case receipts in those three months, compared to 12,300 in the same period last year and 9,700 in the previous quarter. The average appeal still takes about a year to be decided.
