ACCOUNTS PREPARED BY YOUR ACCOUNTANT

Many people think that accounts prepared by an accountant would be 100% accurate but that is not always the case.

It has been discovered in a recent case that an application can be refused by the Home Office if different income is disclosed to the Home Office as opposed to the income submitted to HMRC.

What does this mean?

It means that the Home Office can enquire your HMRC records when considering an application. Therefore, if you disclose different income to Home Office as compared to the income shown to HMRC (whether knowingly or unknowingly) then your application is likely to be refused.

The Upper Tribunal has recently stated in a case that if an accountant providing your accounts information admits making an error with your taxes then the accountant will be required to attend your appeal hearing and give evidence.

The tribunal will not accept a written explanation from an accountant confirming errors as it will not be sufficient to convince the Judge. Therefore, the accountant will need to attend the Court hearing to provide an explanation. Can you imagine your accountant sitting in the Courtroom and waiting to be told off by the Judge? I guess not!

How you can protect yourself?

In order to avoid inconsistencies with your accounts, it is vital to have your accounts prepared and submitted by an experienced accountant, however, what's more important is to check your accounts before submitting with your application to the Home Office in order to avoid the risk of damaging your immigration case which would lead to a refusal.
