New Right to Rent Penalties - What landlords need to know

🗝️ Do you rent out property in the UK? Failing to check your tenants' immigration status can result in substantial fines - up to £10,000 per tenant. Penalties for non-compliance increased significantly on February 14th, 2024.

The Right to Rent scheme, introduced in 2014, requires landlords to verify that potential tenants have the legal right to rent in the UK.

🏡 There are three categories: tenants can have Unlimited Right to Rent (e.g., British citizens), Time-Limited Right (e.g., visa holders), or No Right.

The scheme applies to tenancies after December 1st, 2014 (in some areas) and February 1st, 2016 (nationally).

🧐 Who conducts the check?

The landlord is responsible for performing the check, even if they use a letting agent. However, you can transfer this responsibility to your agent in writing. Verbal agreements are not valid.

⛔ Remember, discriminating against tenants based on their immigration status is strictly prohibited.
