Important changes to the EU Settlement Scheme
Friday 7th June 2024
The Home Office recently announced changes to Pre-Settled Status in the UK. Here are key points:
✈️ Freedom to Travel: Up to 5 Years Outside the UK
One of the most significant changes is extending the permissible absence period for pre-settled status holders. Previously, you risked losing your status if you spent more than two consecutive years outside the UK. Under the new rules, you can now enjoy extended stays abroad for up to five years without jeopardising your immigration status.
✅ Pre-Settled Status will now automatically be extended by a period of 5 years
Extended is the keyword and the most notable change is that previously, it extended by 2 years after a person had completed 5 years, but now it is 5. It benefits those who cannot apply for settled status due to absences. This provides greater peace of mind for those accruing the necessary residence time to qualify for settled status (typically five years of continuous residence).
' Streamlined Checks and Continued Employment/Tenancy
Another positive development concerns the Right to Work and Right to Rent checks. If you are currently employed or hold a tenancy agreement, your employer or landlord will not be required to conduct further immigration checks as long as you remain in your existing position or tenancy.
These changes respond to concerns raised by the Independent Monitoring Authority (IMA), which represents the interests of EU citizens and their relatives in the UK.
The Home Office is expected to release further details and specific timelines for implementing these changes.
While mentioned changes represent a positive step, it is important to note that the deadline to apply for the EU Settlement Scheme has passed (June 30th, 2021). However, individuals who missed the deadline due to reasonable grounds may still be eligible to apply.
